1. Introduction and Acceptance

4. Product Information and Accuracy

ProjectPhi makes reasonable efforts to ensure that product descriptions, specifications, and pricing are accurate and current. However, we do not warrant that all website content is free from errors, omissions, or inaccuracies. We reserve the right, at any time and without prior notice, to correct errors, update information, adjust pricing, and modify or discontinue any product.

Where a pricing or description error is identified after an order is placed, ProjectPhi may cancel the affected order and provide a full refund of any amount paid for that order.

5. Orders and Acceptance

All orders are offers to purchase and are subject to review and acceptance by ProjectPhi. An order confirmation or acknowledgement does not constitute acceptance of an order. ProjectPhi reserves the right, at its sole discretion, to refuse, cancel, or limit any order, including where we reasonably believe an order may breach these Terms or any applicable law or regulation.

6. Payments

ProjectPhi currently accepts cryptocurrency payments through supported third-party payment providers. You are solely responsible for ensuring the accuracy of all payment details, including wallet addresses, before confirming any transaction. ProjectPhi is not responsible for blockchain network delays, transactions sent to incorrect addresses, third-party payment provider outages, or fluctuations in cryptocurrency value. Cryptocurrency transactions are generally irreversible; once confirmed on the relevant network, a transaction cannot be recalled by ProjectPhi.

7. Shipping and Delivery

Shipping timeframes are estimates only and are not guaranteed. Delivery may be affected by carrier delays, customs processing, and other factors outside our control. You are responsible for providing accurate delivery information and for understanding and complying with all import laws and restrictions applicable in your jurisdiction before ordering. ProjectPhi is not responsible for customs seizures, import restrictions, carrier delays, or loss or theft of a package after delivery has been confirmed by the carrier.

8. Returns and Refunds

Due to the nature of the products, all sales are generally final, except where a refund, replacement, or remedy is required by applicable consumer protection law, or is offered at ProjectPhi's discretion.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that applies to you under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where such laws apply, our liability is limited to the extent permitted by those laws.

If there is a problem with your order, you must contact ProjectPhi within a reasonable period after delivery. Subject to the rights described above, replacements or refunds may be provided where you receive an incorrect item, a damaged shipment, or a product is missing. ProjectPhi may decline a discretionary refund request where misuse or breach of these Terms is reasonably suspected.

9. Compliance Responsibility

You are solely responsible for ensuring that the purchase, import, possession, handling, and use of any product complies with all laws, regulations, and restrictions applicable in your jurisdiction. The legal status of these products varies between countries and regions. ProjectPhi makes no representation or warranty regarding the legality of any product in any particular jurisdiction, and it is your responsibility to verify this before ordering.

10. Intellectual Property

All content on this website — including logos, branding, product images, graphics, text, and website design — is the property of ProjectPhi or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any website content without our prior written permission.

11. Limitation of Liability

To the maximum extent permitted by law, and subject to Clause 8, ProjectPhi shall not be liable for any indirect, incidental, special, or consequential loss or damage arising from the use or misuse of products, improper handling of materials, reliance on website information, website interruptions, or shipping delays or issues.

Nothing in this clause limits any liability that cannot be limited or excluded under applicable law, including under the Australian Consumer Law. Where ProjectPhi's liability cannot be excluded but may be limited, our liability is limited, at our option, to resupplying the relevant product or refunding the price paid for it. To the extent permitted by law, products are purchased and used at your own risk.

12. Indemnity

To the extent permitted by law, you agree to indemnify ProjectPhi against any loss, claim, liability, or expense arising from your breach of these Terms, your misuse of any product, or your use of any product in a manner inconsistent with Clause 2.
